Derived from Roman law, the term characterizes a
person charged with the duties of trustee, or a character analogous to that of a
trustee, with respect to the trust and confidence the term evokes, and the
scrupulous good faith and candor which it requires. In the present sense, a Broker assuming a duty, created by an
undertaking, to serve primarily for and in consideration of another in matters
associated with the undertaking, demonstrating the characteristics trust,
fidelity, and forthrightness.
